If I worked 2007 but my husband, who owes back child support, didn't & I claim him will my refund be taken?

His last refund for 2006 was taken. We filed Married seperate, because we had just got married in Sept. Thru out 2007 I have been claiming head of household as an exemption on my tax forms bc I'm the only one working. Do I claim joint although we only had 1 income, mines?
